READ BEFORE ENTERING. These Official Rules contain important information about how the Giveaway will be conducted, and about your rights, including a class action waiver, jury waiver, and arbitration agreement. Participation constitutes agreement to these Official Rules.

This Smart Sadie Member Appreciation Month Giveaway (“Giveaway”) is sponsored byGoettl Home Services, LLC (“Sponsor”), with the prize fulfilled by either Sponsor or its subsidiaries, Las Vegas Peach, LLC, Peach Home Services, LLC, Austin Air Rescue LLC, Phoenix Peach LLC, Nevada Heating (together “Subsidiaries” and individually, each a “Subsidiary”).

Eligibility.  No additional purchase is necessary to enter or win. The Giveaway is open only to current Goettl Smart Sadie members who are at least 18 years of age and whose homes are located within Sponsor’s or its Subsidiaries’ service areas. To receive an entry, an eligible member must satisfy one of the entry requirements described in the “How to Enter” section below. Employees of Sponsor, its parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. This Giveaway is subject to all applicable federal, state and local laws. Void where prohibited.

Giveaway Entry Period. The Giveaway entry period begins on  November 1, 2026, at 12:00 a.m. Pacific Time (“PT”) and ends November 30, 2026, at 11:59 p.m. PT (“Giveaway Entry Period”). Sponsor’s computer is the official timekeeping device for the Giveaway. As described in the “How to Enter” section below, a qualifying service appointment scheduled before the Giveaway Entry Period may qualify if the service is scheduled to be performed during November 2026.

How to Enter. A current Goettl Smart Sadie member will receive one (1) entry by satisfying any one of the following requirements: (a) the member receives at least one (1)  qualifying service from Sponsor or one of its Subsidiaries during November 2026, regardless of when the service was scheduled; (b) during the Giveaway Entry Period, the member schedules and receives a qualifying service with Sponsor or one of its Subsidiaries for an appointment date in November 2026; or (c) during the Giveaway Entry Period, the member schedules a qualifying service appointment but Sponsor or the applicable Subsidiary is unable to complete the service during November 2026 and the qualifying service is completed on or before December 31, 2026. Entries are received and automatically submitted upon receipt of qualifying service. Members who do not wish to participate in the giveaway drawing may opt out by emailing [email protected] with the subject line “Member Giveaway Drawing Opt-Out.” The email must be sent before January 1, 2027, to ensure the member is excluded from participation. Anyone who opts out via email irrevocably forfeits their eligibility to win a prize.

No additional purchase is necessary to enter. Must be a current Goettl Smart Sadie member to qualify for entry. A qualifying service includes: Any service or work performed at an active member’s residential property that is completed and recorded as a completed job in Goettl’s ServiceTitan customer relationship management (CRM) system. Qualifying Services may include, but are not limited to, maintenance visits, drain clearing, repairs, and equipment replacement or installation. A Qualifying Service may be conducted at no additional charge, included as a membership benefit, or performed for an additional charge. Payment for the service is not required for the service to qualify. Scheduled appointments that are canceled, missed, or do not result in completed work do not qualify and any associated entry may be voided and disqualified by Sponsor in its sole discretion.

Limit one (1) entry per eligible member, regardless of the number of qualifying services received or scheduled. Any entries in excess of limit are void. At least one scheduled, qualifying service must be received to remain eligible. 

Any and all entries that are early, late, lost, illegible, unintelligible, garbled, incomplete, damaged, destroyed, irretrievable, forged, manipulated, tampered with, modified, edited, adjusted, noncompliant, or otherwise inconsistent with the requirements of these Official Rules may be disqualified at Sponsor’s sole and absolute discretion. Entries generated by script, macro, or other automated or artificial means and entries by any means which subvert the entry process are void. Attempts by an entrant to circumvent these Official Rules will subject entries to disqualification.

By participating, entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Giveaway, including, without limitation, interpretation of the Official Rules.

In the event of a dispute as to the identity of any entrant, the entry will be deemed to be that of the holder of the email account associated with the membership and service reservation but only if such person is otherwise eligible. The “account holder” is the person assigned an email address or service by the organization responsible for assigning addresses for the domain associated with the submitted address.  Winner may be required to show proof of being the registered account holder.  If a dispute cannot be resolved to the Sponsor’s satisfaction, the entry will be deemed ineligible.

Prize. One (1) winner will win winner’s choice of either (a) one (1) new Smart Thermostat or (b) a comped renewal of winner’s existing Smart Sadie Membership Plan (or of the next highest plan if winner’s plan is no longer offered*). Approximate retail value (ARV) of Prize varies depending on the prize selected and, if applicable, the existing membership level at time of entry; however, ARV will not exceed $1,500. Only one (1) person can win.

Prize has no independent cash value and is not redeemable for cash. Any price differential between the stated ARV maximum and the actual prize awarded is not payable to the winner. No substitution, transfer, or cash equivalent is permitted except by Sponsor in its sole discretion. Winner is solely responsible for each and all respective taxes, expenses, and other costs associated with receipt of Prize. No more than the stated Prize will be awarded.

*For current subscribers to a membership plan that is no longer offered by Sponsor, the prize awarded will be a comped renewal at the next available level. Sponsor currently offers two different Smart Sadie membership plans, each with a one-year option. In the past, Sponsor may have offered other membership plans at other duration increments. Any such plans which are no longer offered are non-renewable. Accordingly, if the selected winner’s existing membership plan is one that is no longer offered, the next highest value plan will be awarded as the prize and such a “comped renewal” (albeit for a lesser duration) will be automatically reflected in the winner’s account and honored at the time of the existing plan’s expiration. For clarity, and by way of example, if the winner currently holds membership plans covering 3 homes, each with a 5-year duration including the Goettl App Only, then the winner will be renewed for 3 membership plans at a 1-year duration, for the Goettl App Only, covering the 3 homes.

Odds. Odds depend on number of eligible entries received.

How to Win. One winner will be selected by random draw in January 2027 from among all eligible entries received. Sponsor will endeavor to notify the winner on or before January 31, 2027, by phone and/or email, to determine prize selection. If the selected winner chooses a Smart Sadie Membership Plan renewal, the prize will be automatically applied to the winning membership account by Sponsor and/or the applicable Subsidiary such that the awarded membership plan will be effectively auto-renewed and at no cost to the winner. If the selected winner chooses a Smart Thermostat, Sponsor and/or the applicable Subsidiary will coordinate prize fulfillment with the winner. If Sponsor is unable to reach winner or is unable to effectively communicate with winner in order to coordinate prize fulfillment within five (5) days of initial outreach by Sponsor, or if such winner declines the Prize, this initial winner will be deemed to have forfeited the Prize and Sponsor may select a new winner by random draw in its sole discretion. Sponsor shall have no further obligation to attempt to draw another winner and issue the Prize, but may do so in its sole discretion, if it so chooses.

Sponsor is not responsible for and shall not be liable for late, lost, garbled, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winner.

Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent value prize substitutions in its sole discretion.

To be eligible to win, entrant must reside within the applicable Sponsor and Subsidiary service areas. The qualifying home(s) associated with the eligible entrant will be the residence where the Prize is to be applied. Location will be verified in order to win. Sponsor may disqualify any potential winner in its sole discretion if potential winner does not satisfy all criteria for verification.

Miscellaneous: Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of Prize, whether or not specifically stated herein, are the responsibility solely of the Winner. Winner may be required to provide Sponsor with a valid social security number or tax identification number for tax reporting purposes before their prize will be awarded.  An IRS Form 1099 may be issued in the name of the winner for the value of the Prize.  Unclaimed prize(s) will be forfeited.

Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent value prize substitutions at its sole discretion.

General Conditions: By participating, entrant consents to receive communications from Sponsor related to this Giveaway and agrees to be bound by these Official Rules. Entrant also agrees to continue to receive promotional email from Sponsor and its Subsidiaries and may opt out from such communications at any time. Note that if entrant opts out from communications from Sponsor during the course of this Giveaway, entrant may be forfeiting the chance to win if Sponsor or its Subsidiaries are not authorized to contact entrant.

Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of it, if any fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, garbled, or illegible entries, whether electronic or mail; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or electronic submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS GIVEAWAY OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any website associated with the Giveaway, and/or the legitimate operation of the Giveaway; to violate or otherwise fail to comply with the Official Rules; or to act in an unsportsmanlike, inappropriate, lewd, lascivious, or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Giveaway is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect entries, modify the Giveaway or suspend the Giveaway to address the impairment, and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules, or Sponsor may alternatively determine to end the Giveaway early and award the Prize in accordance with these Official Rules from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor’s administration of this Giveaway is final and binding.

The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision or of the Official Rules generally. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Giveaway-related materials, privacy policy, or terms of use on a Giveaway-related website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control.

By participating, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the Giveaway, including interpretation of these Official Rules and the winner determination process. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of any of these Official Rules, or in a disruptive manner, and void any associated entries. 

Limitation of Liability. By entering, entrants agree to release and hold harmless Sponsor and its Subsidiaries, and each of their respective affiliates, advertising and promotion agencies, partners, representatives, agents, attorneys, successors, assigns, employees, officers and directors (the “Released Parties”), from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Giveaway and/or the entrant’s acceptance, possession, use, or misuse of Prize or any portion thereof; (ii) unauthorized human intervention in any part of the Giveaway; (iii) electronic or human error in the administration of the Giveaway or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail or electronic mail or transmission; (viii) impossibility, Act of God, or frustration of purpose; or (ix) based on publicity rights, defamation or invasion of privacy.

Disputes, Venue, and Governing Law. This Giveaway is governed by and shall be construed in accordance with the laws of the State of Nevada, without resort to conflict of laws principles. By participating in this Giveaway, entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action. Entrant further agrees that any such disputes and causes shall be resolved exclusively by final and binding arbitration in Clark County, Nevada, in accordance with the American Arbitration Association (AAA). Any demand for arbitration must be filed within one (1) year from the end of the Giveaway Entry Period or the cause of action shall be forever barred.

There is no judge or jury in arbitration, and ENTRANT EXPRESSLY WAIVES RIGHT TO A JURY TRIAL. The arbitration will be conducted before a neutral single arbitrator, whose decision will be final and binding, and the arbitral proceedings shall be governed by the AAA Commercial Arbitration Rules, Consumer Due Process Protocol, and Supplementary Procedures for Resolution of Consumer Related Disputes.

In the event that a court of competent jurisdiction finds the foregoing arbitration provisions invalid or inapplicable, entrant acknowledges and agrees that jurisdiction shall be exclusively in the federal and state courts located in Clark County, Nevada, and entrant further agrees to submit to the exercise of personal jurisdiction of such courts for the purposes of litigating any applicable dispute or claim.

BY ENTERING THIS GIVEAWAY, ENTRANT AGREES TO WAIVE ANY RIGHT TO A TRIAL BY JURY AND FURTHER AGREES AND ACKNOWLEDGES THAT ANY CAUSE SHALL BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.

Further, the remedy for any such dispute or claim shall be limited to actual damages, and under no circumstances shall entrant be permitted to obtain awards for, and entrant hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e., costs associated with participating in the promotion, if any) not to exceed one hundred dollars ($100.00). Entrant irrevocably waives all rights to have damages multiplied or increased, or to rescind this agreement or to seek injunctive or any other equitable relief. Entrant agrees that remedies are limited to a claim for money damages (if any).

Publicity. Except where prohibited, participation in the Giveaway constitutes winner’s consent to Sponsor’s and its Subsidiaries’ and their respective agents’ use of winner’s name, likeness, photograph, opinions, and/or location(s) for promotional purposes in any media, worldwide, without further permission, payment, or consideration.

Privacy Policy. By participating in this Giveaway, each entrant expressly consents to the Sponsor and its Subsidiaries, and all of their respective agents, employees, and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Giveaway and in accordance with Sponsor’s privacy policy. All personal information collected is subject to the Goettl Privacy Policy, available at https://www.goettl.com/privacy-policy-and-terms-of-service/.
